Since July 2015, when O.L. 1/2015 amended the Criminal Code, the provision that the Crime Prevention Models (also called “Compliance Programs”) are cause for exemption from criminal liability of companies has been expressly incorporated. Thus, although legal entities cannot commit all the offenses provided for in the Criminal Code, this amendment includes 26 groups of offenses which, despite being committed by individuals, can give rise to the liability of a legal entity with the corresponding criminal and economic consequences, in addition to the serious impact on its reputation and good image.
The implementation of an effective Crime Prevention Model in the company prevents the commission of crimes by the legal entity. Currently, a Crime Prevention Model is a key element to prevent conviction in the company.
In SAGUÉ CRIMINAL LAWYERS we offer advice to companies and private and public entities within the framework of the so-called “Economic Criminal Law and Corporate Compliance”, by virtue of which and after conducting an exhaustive analysis of the business culture of the entity, we issue recommendations, reports, and implement, review and update crime prevention programs with the sole purpose of preventing any business conduct that may entail criminal risks for the Company and/or for its administrators, managers and even for its employees.
